SPURSICHER Terms and Conditions

organization
SPURSICHER is owned by Vittorio Wyssbrod.

SPURSICHER specializes in two-wheel events and offers driver training, tours, holidays and events with qualified guides.

 

Group tours / driver training

Are events with a defined program, accommodation and costs.

The constellation of the group is determined by the participants & Spursicher.

The journey is usually individual and is not part of the tour / event program / offer.

 

Registration
Please register as early as possible by phone or email. The registration deadline is noted on the job advertisement or on the Internet. Short-term bookings are possible after consultation by telephone if there are still places available. The registration is binding.

 

confirmation
After the registration has been received, the participant will receive an event confirmation by email or WhattsApp (invoice).

 

pay

The registration becomes legally valid after receipt of payment. The participant receives a booking confirmation and travel information.

Any remaining amounts are to be paid to the organizer on site.

Other payment methods (e.g. for weekly trips, short-term driver training) are specifically mentioned.

 

material
With the booking confirmation, the participant receives a material list that is adapted to the tour / trip. Participants are responsible for their own personal or rented equipment.

 

Arrival and departure
The journey to and from the meeting point / destination is usually individual. The travel costs are not part of the event package and are also borne by the participant.

In the case of customer events, the return journey can be an integrated part of the event package; this is then specifically mentioned.

 

Cancellation by the participant

The participant can withdraw from the travel contract at any time up to the start of the journey. In the event of a withdrawal, the receipt of the written declaration of withdrawal is decisive.

If it takes place up to the 60th day before the start of the journey, we will reimburse you the invoice amount minus a cancellation fee of 20%


59 to 31 days before the start of the trip: 30% of the invoice amount
30 to 21 days before the start of the trip: 50% of the invoice amount

20 to 11 days before the start of the trip: 70% of the invoice amount
10 to 1 days before the start of the trip: 90% of the invoice amount
7 to 0 days before the start of the trip: 100% of the invoice amount


Should a participant prematurely cancel or interrupt the tour / trip, he or she is not entitled to a refund. The participant who cancels can provide a replacement, provided this meets the special requirements of the tour offer.

Instead of the cancellation costs, a fee of CHF 50.00 will be charged.

We recommend that participants take out cancellation insurance.

 

Cancellation by the organizer (SPURSICHER)
We reserve the right:
- To cancel trips, tours & events if there is not enough participation or to suggest a rebooking to the participants;
- To cancel the trip / tour in very bad weather conditions, natural forces, accidents, sudden illness of the tour guide and similar events or to break off prematurely.

In such a case, the customer is not entitled to any reimbursement for outstanding services by the organizer. (track safe)

Amounts already paid will not be reimbursed to the participant. Further claims are excluded.

 

Postponement of tours, change of program
The tours always take place in accordance with the announcement. However, the organizer reserves the right to make changes to the program at short notice, even during the tour, for special reasons such as precarious weather conditions, force majeure, illness, whereby the organizer endeavors to offer an equivalent replacement service. Any additional or reduced costs will be invoiced or reimbursed to the participant.

 

Leadership, support and supervision
The tour guide is available during the tour for the overall management of the group and only in exceptional cases for the personal care of the individual guests. The decisions made and instructions given by the tour leader are in the interests of the group and must be followed. If a guest persistently and repeatedly opposes the tour guide's decisions, he can exclude him from the tour / trip.

In this case, the guest is not entitled to any financial compensation claims.

 

personal requirements
A good physical condition and condition is essential for your safety and the success of the tour / trip. The personal requirements depend on the degree of difficulty according to the advertisement of the tour / trip. The customer informs the organizers of any physical or psychological conditions that could affect the trip or his health during the trip.

 

individual responsibility
Mountain biking is associated with an increased risk. A considerable degree of personal responsibility and prudence on the part of the participants as well as compliance with the rules of conduct for mountain bikers is required.

 

The participant undertakes:
- for mutual recognition, respect, helpfulness and camaraderie in the group;

- not to drive beyond one's means and abilities;

- Immediately communicate any feeling of overwhelming or problems with biking to the tour guide
- to an environmentally conscious behavior;
- to follow the instructions of the tour guide;
- In the event of an accident, not to give any information (comments, reports, personal messages, letters, etc.) about the trip / tour to the public without the express consent of the guide or organizer.

equipment

When it comes to bike tours and events, it is mandatory to wear a helmet and gloves to protect yourself against injuries in the event of an accident. If this obligation is not complied with, the tour guide reserves the right to exclude participants from tours without compensation. Participants in bike tours undertake to start the journey with a well-maintained bike that is adapted to the needs of the tour. Under no circumstances is the organizer liable for personal injury or property damage caused by the poor condition of a mountain bike.

 

Liability and Compensation
SPURSICHER and its tour guides strive to ensure the greatest possible safety for the participants. Tours in nature and especially in alpine terrain are always associated with risks. By registering for a SPURSICHER event, the customer expressly recognizes these dangers and waives any claims for damages or other claims against SPURSICHER and employees in the event that the risk arises. By registering for the event, the participant also confirms that they have adequate insurance cover and that they are not overestimating their mountain biking skills:

Participation in a SPURSICHER event is at your own risk.

 

insurance

Insurance is the responsibility of the participant. Participation in the SPURSICHER events is at your own risk. It is strongly recommended that every participant take out comprehensive accident insurance including mountain risks and rescue costs. The participant must insure his property (bike, equipment) privately.

Rega membership is recommended.

 

Pictures, website

The participant does not claim any copyright to photos or videos that are made during the tour. He agrees that this image material may be used in the media and on the SPURSICHER.CH website. If the participant does not want this, he should note this when registering or notify us at the latest during the event.

 

Applicable Law and Jurisdiction

Swiss law applies. The place of jurisdiction is Sempach. Sempach, January 1st, 2021
